Types of Power of Attorney in Turkey

1. General Power of Attorney: This gives the agent broad authority to represent you legally in all matters, and in some cases, your signature is required for approval.
2. Specific Power of Attorney: This gives the attorney the authority to act on your behalf in a specific transaction, in this case, the purchase of a property
The process of obtaining a power (POA) of attorney to buy property in Turkey:

A.If you are in Turkey, granting a power of attorney is as follows:
Any Turkish notary can issue a power of attorney. When you bring the required documents to the notary's office, the POA form will be prepared for you.
Non-Turkish speakers must use a sworn translator because all documents related to notary public transactions related to the purchase of property in Turkey are in Turkish. The contents of the POA documents will be accurately translated by sworn notary translators. You must pay the applicable fees after completing the necessary documents and signing to receive your receipt.
B. If you are outside of Turkey, the granting of a power of attorney is as follows:
Countries that have signed an apostille agreement with Turkey can instead use this second solution. You can take your power of attorney to a notary office in your country and then to a competent authority, such as the district governorate or the municipality, where it will be apostille-certified. Finally, you must send the paperwork to Turkey, where it must be notarized.
It is important to note that some POAs are only valid if they include photographs. As requested, have your notary include a photo of you on this power of attorney. Because granting POA requires a Turkish tax ID number, when applying from outside Turkey, your passport number replaces your Turkish tax ID number.
